My original case concerned retaliation for my complaints about three buildings built adjoining my former property that were so far out of compliance with the zoning that to this day they are not listed on the property tax rolls. In June 2008 a David Engle burned to death 6 blocks away in a housing unit that violated the zoning, wasn't on the property tax rolls, and had no secondary exit. People in the know in Steamboat Springs learned that they can get away with zoning violations. The assessor, Mike Kerrigan, said that there are many illegal buildings in Steamboat and enforcement of the regulations is lax.
Yes I did "flee" from Colorado to Wisconsin. There was a bullet hole thru our Steamboat Springs' window and after I moved to Wisconsin a man sent me an email saying that when he, his wife, and his family were walking my property, which had a for sale sign, my former neighbor threatened to shoot them. My impression at the time is that my neighbor was trying to get my 15 year old son into a fight by going in our back yard and taunting him and that if he engaged my son in a fight he might kill him. My neighbor's wife asked the police to arrest me because she followed me thru WalMart trying to take my picture to prove that I was near her.

Why shouldn't I try to defend myself against a judgment that didn't comply with Rules 52a, 54a, and 58a? Former Judge Edward Nottingham's only explanation of why he dismissed my case was that a previous case that was never served and to which there were no responsive pleadings which was dismissed without prejudice after I filed a motion saying I was switching to federal court should cause res judicata. That violates S.C. decisions.

Well stap me! Who'd have thought that the chap I remember being sent off (by Ken Girkin) during a house rugby match, for pummelling Steve Roseburgh's back during a ruck, would have turned out to be immersed in the NFL! I can still see the surprised look on Steve's face - it had to be the softest dismissal ever. Dear old Ken applied the letter of the law I suppose.
